Landmark and Blue Cross ordered to go into mediation

Landmark Medical Center went to court today to seek permission to sue Blue Cross Blue Shield of Rhode Island. Instead, Judge Michael Silverstein ordered the two sides to work it out.

According to Craig Burke, the court spokesman, Judge Silverstein is sending the two sides to mediation.

Landmark’s spokesman Bill Fischer says he’s pleased with the decision.

If mediation is a path towards reconciliation of a number of unresolved issues and it brings all parties to the table in a reasoned manner, I think that’s a productive day.

Fischer says some of the negotiations will only concern Blue Cross and Landmark, but Steward plans to participate in parts of the mediation that apply to them.

Blue Cross hasn’t returned my request for reaction to the decision.

Here’s a response from Blue Cross Blue Shield-

Blue Cross & Blue Shield of Rhode Island is  supportive of Judge Silverstein’s recommendation that the parties enter into mediation and are hopeful that  this process will allow the parties to reach resolution on the open issues.

Craig Burke with Superior Court says Judge Silverstein will likely name the mediator and work out other details in court on Monday.

    Not being a member of the bar, it is unclear to me what jurisdiction the Judge has yto “order” Blue Cross into “mediation” and whether any determinations made by such “court ordered mediation” are binding upon the parties. I am sure Blue Cross has many attorneys to protect its interests.

    This seems like more extortion of any and all RI entities by Landmark/Special Master/Court/Steward.

    The court and its agents have botched this from day one (nearly four years ago!) and continue their course with this move.,

      Hi Moe-

      Craig Burke told me the judge has the power to send them to mediation, but no power to force them to settle. So yes, they have to try to work things out, but no guarantee that they will.

    Steward is taking maximum advantage of its bargaining position. No one wants to be cited as a reason that Steward declined to actually acquire Landmark.
